The prevention of human rights violations
Contribution on the occasion of the Twentieth Anniversary of the Marangopoulos Foundation for Human Rights (MFHR)

This Volume contains the contributions to an International Colloquy held in Athens on the occasion of the twentieth anniversary of the Marangopoulos Foundation for Human Rights. The question of the prevention of human rights violations is approached from the following perspectives.
Provisions of certain conventional instruments. The Volume contains an in-depth analysis of the activities of the Committee on the Prevention of Torture under the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment, an instrument the primary purpose of which is prevention. Another important instrument examined in this respect is the Framework Convention for the Protection of National Minorities. The activities of United Nations treaty bodies under the relevant international instruments are also discussed, as is the preventive aspect of the activities of the ad hoc International Criminal Tribunals for the former Yugoslavia and Rwanda and of the International Criminal Court.
Non-conventional monitoring mechanisms. The United Nations, the OSCE and the Council of Europe have established a number of mechanisms to monitor compliance with human rights obligations. These mechanisms also play a preventive role. The focus is in particular on the activities of UN Special Rapporteurs, the OSCE Field Missions, the European Commission for Democracy Through Law (Venice Commission) and the Council of Europe in general.
International Commissioners and Ombudsmen. Such institutions have been established at both the universal and regional level and can play an important role as regards the prevention of human rights violations. Special emphasis is placed on the preventive action of the United Nations High Commissioner on Human Rights, the United Nations High Commissioner for Refugees, the Commissioner of Human Rights of the Council of Europe as well as the European Ombudsman.
National Ombudsmen and Human Rights Institutions. International and regional activities for the prevention of human rights violations are not sufficient. An important role falls also on national mechanisms, such as national Ombudsmen and National Human Rights Institutions. Concrete examples are provided in particular by the activities of the French National Advisory Commission on Human Rights and the Greek National Commission for the Protection of Human Rights.
Emergence of a human rights culture. The goal of preventing human rights violations cannot be achieved through institutional action alone. Civil society is also called upon to play its part. It is further essential to foster the development of human rights education.
The Volume closes with a theoretical synthesis of the various approaches to the prevention of human rights violations, focusing on the context, the concept and function, as well as methods and techniques of prevention.
